1. Acceptance of Terms

By downloading, installing, or using SurfacePro (“the app”), you agree to these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

SurfacePro is a surface measurement tool for iOS that uses ARKit augmented reality and GPS technology to help users measure real-world surface areas. The app provides two measurement modes:

  • AR Mode: Uses the device camera and ARKit to place measurement points in augmented reality
  • GPS Mode: Uses device GPS to place measurement points at real-world coordinates

3. Measurement Accuracy Disclaimer

Important: SurfacePro is designed as a practical measurement aid, not a certified surveying instrument.

  • Measurements are estimates and may vary based on device hardware, environmental conditions, lighting, surface type, and GPS signal quality
  • AR mode accuracy depends on device capabilities (LiDAR-equipped devices provide higher accuracy)
  • GPS mode accuracy depends on satellite signal quality and may vary by several meters
  • Do not rely on SurfacePro for legal surveys, property boundaries, construction engineering, or any application where measurement errors could result in financial loss, property disputes, or safety hazards
  • For professional or legal purposes, always consult a licensed surveyor

4. In-App Purchase

Free Tier

The app offers basic functionality for free, including limited measurement points per polygon and a limited number of saved measurements.

Pro — One-Time Purchase

  • A single, one-time purchase unlocks all Pro features permanently, including unlimited measurement points, unlimited saved measurements, multi-polygon support, export capabilities (PDF, KML, GPX), polygon distance analysis, and diagram annotations
  • There is no subscription and no recurring charges
  • The price is displayed in the app before purchase
  • Payment is charged to your Apple ID account at confirmation of purchase

Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple according to their refund policy.

5. Acceptable Use

You agree to use SurfacePro only for lawful purposes. You may not:

  • Use the app to trespass or measure property you do not have permission to access
  • Reverse engineer, decompile, or disassemble the app
  • Redistribute, sublicense, or resell the app or its content
  • Use the app in any way that violates applicable laws or regulations

6. Intellectual Property

SurfacePro, including its design, code, graphics, and content, is owned by the developer and protected by copyright and intellectual property laws. Your purchase grants you a limited, non-exclusive, non-transferable license to use the app for personal or professional measurement purposes.

7. Privacy

Your use of SurfacePro is also governed by our Privacy Policy. By using the app, you consent to the data practices described in the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law:

  • SurfacePro is provided “as is” without warranties of any kind, express or implied
  • We do not warrant that measurements will be accurate, complete, or error-free
  • We are not liable for any damages arising from your use of or inability to use the app, including but not limited to direct, indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless the developer from any claims, losses, or damages arising from your use of SurfacePro, including any reliance on measurements provided by the app.

10. Termination

We reserve the right to terminate or suspend your access to the app at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the app.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app after changes constitutes acceptance of the new terms. Material changes will be communicated through app updates.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to conflict of law provisions.

13. Apple's Standard EULA

In addition to these terms, your use of SurfacePro is subject to Apple's Standard End User License Agreement (EULA) for licensed applications.
